1. Scope

These Terms of Use govern the access to and use of the device control platform provided by KinkyStuffMade.

These Terms apply exclusively to the use of the platform and do not govern the purchase of products via the webshop.

3. Service Description

We provide a web-based platform that allows users to connect to and control compatible devices (e.g. Bluetooth-enabled hardware).

Certain features may require an active user account.

4. User Account

You must provide accurate and complete information
You are responsible for maintaining the confidentiality of your login credentials
You are responsible for all activities under your account

5. Permitted Use

No misuse or abuse of the platform
No interference with security or functionality
No unlawful use of the service

6. Availability

The service is provided "as is". We strive to ensure availability but do not guarantee uninterrupted or error-free operation.

7. Device Functionality

Device performance depends on external factors such as hardware condition, connectivity, environment, and proper usage.

We do not guarantee compatibility with all devices or environments.

8. Liability

We are liable without limitation for intent and gross negligence as well as for damages resulting from injury to life, body, or health.

In cases of slight negligence, we are only liable for the breach of essential contractual obligations (cardinal obligations). In such cases, liability is limited to foreseeable, typical damages.

Any further liability is excluded.

9. Data Protection

Information on how personal data is processed can be found in our Privacy Policy.

10. Suspension and Termination

We reserve the right to suspend or terminate access to the platform in case of violations of these Terms.

11. Changes to the Service

We may modify or discontinue parts of the service at any time, provided this is reasonable for users.

12. Applicable Law

These Terms are governed by the laws of the Federal Republic of Germany.

If the user is a consumer within the European Union, mandatory consumer protection laws of the country of residence remain unaffected.

14. Subscriptions and Auto-Renewal (iOS App)

If you choose to subscribe to our Pro service via the iOS app, the following terms apply:

Subscription Details: The subscription renews automatically at the end of each billing period (yearly) unless canceled before the renewal date.
Free Trial: We offer a 14-day free trial. If you do not cancel before the trial ends, your subscription will automatically renew and you will be charged the subscription price.
Price: The current subscription price is displayed before you complete your purchase.

15. Cancellation and Management (iOS App)

You can manage and cancel your subscription at any time:

iOS: Open Settings → [Your Name] → Subscriptions → Select the subscription → Tap "Cancel Subscription"

Cancellation takes effect at the end of your current billing period. You will retain access until the renewal date.

16. License Purchase (Web)

If you purchase a license via our website, the following terms apply:

License Duration: You receive a one-year license for the Pro service.
No Auto-Renewal: Your license does NOT automatically renew. You will need to manually renew your license after the one-year period if you wish to continue using the Pro service.
License Expiration: Once your license expires, your account will revert to the free plan.

17. Refund Policy

iOS App: Refunds are handled in accordance with Apple's App Store refund policy. For requests regarding App Store purchases, please contact Apple directly at: support.apple.com/contact

Web License: We do not offer refunds for web-based license purchases. For refund requests, please contact us at info@lockmebox.com

18. Changes to Terms

We may change the subscription or license terms with prior notice. Continued use of our service after notification constitutes acceptance of the new terms.
